Terms of Service

1. Acceptance of Terms

By using Claw Post's services – including the postclaw.net website, API, and Chrome extension – you agree to these Terms of Service. This is a binding legal agreement between you ("User") and Daydreamnation Tech Labs LLC (the "Company"). Your access to or use of the Service (website, API, or extension) constitutes your acceptance of these Terms. If you do not agree, do not use the Service. The Service is provided by Daydreamnation Tech Labs LLC, a Delaware limited liability company, and these Terms apply to all users of Claw Post and its extension and API.

2. Description of Service

Claw Post provides a cloud-based relay API and browser extension that enables automated posting to social networks (initially X/Twitter) using the user's own social media accounts. Claw Post does not create or provide any social media accounts, and it is not affiliated with or endorsed by X/Twitter or any other social network. Instead, our extension uses the social network sessions already logged in your browser to post content that you initiate (or that your API client initiates on your behalf). You remain responsible for compliance with all applicable social network terms and policies; Claw Post does not guarantee that any post will be approved or remain published by those networks.

3. Eligibility

You represent and warrant that you are at least 18 years old and have the full legal capacity to enter into this agreement. If you use the Service on behalf of a company or organization, you further represent that you have the authority to bind that entity to these Terms. Any accounts registered for minors or for persons without proper authority may be terminated at the Company's discretion.

4. Accounts and Security

You are responsible for maintaining the security of your Claw Post account, API keys, and any credentials used to access Claw Post. You must keep your password and API keys confidential and not share them. You agree to notify us immediately of any unauthorized use or breach of your account or API credentials. You are liable for all activities that occur under your account. If we reasonably believe an account has been compromised, or is being used in violation of security or law, we may suspend or restrict that account to protect our network and other users.

5. Payments and Billing (Stripe)

Any paid subscriptions or fees for Claw Post are processed through Stripe, a third-party payment processor. Subscription fees are billed in advance on a recurring (e.g. monthly or annual) basis. We may change our pricing or subscription fees from time to time, but we will provide you with advance notice of any fee increase before it takes effect (effective at the end of your then-current billing period). Except where required by law, all paid subscription fees are non-refundable. All fees are stated exclusive of taxes; you are responsible for payment of any sales taxes, VAT, GST, or other taxes imposed on the transaction. If payment is not received when due, we reserve the right to suspend or terminate the Service until payment is made. By paying through Stripe, you agree that Stripe's Terms of Service and Privacy Policy apply to those transactions.

6. Acceptable Use Policy

You agree not to use Claw Post or its extension for any unlawful or abusive purpose. In particular, prohibited uses include (but are not limited to):

  • Spam or Unwanted Messaging: Sending unsolicited bulk or harassing messages, ads, or promotions via social networks.
  • Harassment, Hate, or Threats: Posting content that threatens, harasses, bullies, or promotes hate against any individual or group.
  • Illegal Activities: Any content or activity that violates laws or infringes on the rights of others.
  • Impersonation or Misrepresentation: Pretending to be another person or company, or falsely implying endorsement by a social network or any third party.
  • Malware and Hacking: Transmitting viruses, worms, malware, ransomware, or any harmful code, or using the Service to gain unauthorized access to computers or networks.
  • Fraud or Phishing: Any attempt to defraud others or obtain sensitive information by deceptive means (including phishing campaigns).
  • Political or Misinformation Campaigns: Using Claw Post to manipulate opinions or spread intentionally misleading political content.
  • Violation of Platform Rules: Using the Service in a way that violates the terms or policies of any social network you connect to.
  • Excessive Automation or Abuse: Overuse of the Service that might be considered abusive (such as massively high frequency posting outside of normal user behavior).

We may immediately suspend or terminate accounts that violate this Acceptable Use Policy. Claw Post reserves the right to refuse service, terminate accounts, or disable features for users who violate these rules.

7. Third-Party Services

Claw Post integrates with third-party social networks (currently including X/Twitter). We have no control over those networks, and Claw Post posts content using your own account sessions on those platforms. You acknowledge that such third-party platforms can change or discontinue their services or APIs at any time, and Claw Post cannot guarantee your posts will always succeed or remain accessible. Claw Post is not affiliated with X Corp. or any social media company and makes no warranties about the availability or content of third-party services. You agree that Claw Post is not responsible for any act or omission of any social network or other third-party services.

8. Browser Extension Disclosure (Chrome Web Store Requirements)

The Claw Post Chrome extension operates entirely within your browser. It uses the social media session cookies and data you have authorized (e.g. your logged-in X/Twitter session) to perform actions that you initiate or that your Claw Post API client initiates. The extension does not collect or transmit your browsing history or data outside what is strictly necessary for its functionality. We do not sell your personal data, inject ads, or track you outside the scope of the Claw Post functionality. Any permissions requested by the extension are required for the features you have enabled. In compliance with Chrome Web Store policies, we disclose that no personally identifying data is sold or shared with unrelated third parties, and no unrelated ad content is injected by our extension.

9. Data and Privacy

Claw Post processes the data necessary to operate the Service, including the content of posts you send through the Service, API usage logs, and account/profile metadata. We take reasonable technical and organizational measures to protect your data. We encourage you to review our Privacy Policy for details on what information we collect, how we use it, and your rights. By using Claw Post, you consent to the data practices described in that Privacy Policy.

10. Service Availability and Changes

Claw Post may change, update, or discontinue parts of the Service at any time. We may add or remove features, or change pricing and terms, and will attempt to give notice of significant changes. You acknowledge that because the extension relies on third-party websites (social networks), it may stop working if those sites change their login flows or APIs. Claw Post will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Service.

11. Disclaimers

The Claw Post Service is provided "as is," without any warranty of any kind. We do not guarantee that the Service will be uninterrupted, error-free, or secure. We make no warranty that any content you submit will be successfully posted to or remain on a social network. TO THE MAXIMUM EXTENT PERMITTED BY LAW, DAYDREAMNATION TECH LABS LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. You assume all risk for how you use the Service.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO THIS AGREEMENT OR YOUR USE OF THE SERVICE. This includes, but is not limited to, lost profits, data loss, or service downtime. Our total liability to you for any claim arising from the Service shall not exceed the aggregate fees you have paid us in the twelve (12) months preceding the event giving rise to the claim.

13. Indemnification

You agree to defend, indemnify, and hold harmless Daydreamnation Tech Labs LLC, its officers, directors, employees, and agents from any losses, claims, liabilities, damages, or expenses (including reasonable attorneys' fees) arising from or related to your use of the Service. This includes claims arising from your violation of these Terms, your violation of any law or third-party rights, your content or materials posted through the Service, any misuse of your account, and any actions or damages caused by your violation of a third party's terms of service.

14. Termination

You may cancel and terminate your Claw Post subscription at any time. Cancellation takes effect at the end of your current billing period. Upon termination, your right to use the Service ceases immediately. Daydreamnation Tech Labs LLC may suspend or terminate your account if: (a) you breach these Terms; (b) your use of the Service presents a security risk or legal risk; or (c) we believe your actions violate the Acceptable Use Policy. Termination or suspension does not relieve you of obligations due or accrued prior to termination.

15. Governing Law

This Agreement and all disputes arising out of it shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflicts of law principles. Any legal suit, action, or proceeding arising out of or related to this Agreement must be instituted in a federal or state court located in Delaware. You waive any jurisdictional or venue defenses to the extent permitted by law.
